What data does the CIS contain exactly?

The CIS maintains three types of data. The most serious category is the External Referral Register (EVR): this contains companies and individuals with proven or strongly suspected fraud. Registration can last eight years and in practice leads to automatic rejection of new applications. The Incidents Register records elevated risks without fraud having been established, usually for five years. The Risk Register contains general information on claims history or living and working environment, not always fraud-related.

Step 1: request the file

Step 2: submit a notice of objection

Send a reasoned objection with explanation, supporting documents and a request for removal. The insurer must respond within four weeks.

Step 3: involve Kifid

If rejected, you can go to Kifid. There too you can challenge the registration yourself. The procedure takes six to twelve months and costs fifty euros.

Step 4: court proceedings

In complex cases or cases involving major damage, interim proceedings before the Rechtbank Zeeland-West-Brabant (Breda) are possible, or a full action for damages.

Damages and time limits

The Hoge Raad has held insurers liable for incorrect registrations. Missed policies, higher premiums and lawyer’s fees can lead to damages ranging from several thousand to tens of thousands of euros. Note the limitation period of five years from the moment the registration became known, the maximum EVR duration of eight years and the Kifid complaint period of one year.
