In Tilburg, the amount of a deposit is legally limited to prevent abuse, especially in the vibrant rental market around the Spoorzone and the University. In the rental sector, a deposit may amount to a maximum of three months' rent (art. 7:285 DCC), unless the parties agree otherwise in exceptional cases. For room rental, popular among Tilburg students, a maximum of one month's rent applies. For the purchase of real estate in neighbourhoods such as the Heikant or the city centre, no fixed maximum is laid down, but reasonableness and fairness (art. 6:248 DCC) are decisive; often 10% of the purchase price is used. Excessively high deposits can be declared invalid by the district court in Tilburg. Calculate the deposit taking into account local risks such as damage from carnival celebrations or non-payment. Landlords in Tilburg must deposit the deposit with a recognised institution such as the Central Government or the local branch of the Tenants' Union. Exceedance may lead to recovery via the Rent Tribunal and fines.
